Washington Redskins defensive end Bruce Smith was acquitted of a driving under the influence charge yesterday in Virginia Beach.

Smith, 39, was arrested on April 27 near his home in Virginia Beach and charged with DUI despite passing a breathalyzer test. His blood alcohol level registered .07, below Virginia’s legal limit of .08. But Virginia law allows an officer to arrest a driver who passes a breathalyzer test if there are other signs of impairment.
