Pennington Pleads No Contest to DUI

Ty Pennington, host of ABC's "Extreme Makeover: Home Edition," pleaded no contest Friday in a misdemeanor drunken driving case. Pennington, 42, had been charged with two misdemeanor counts _ driving with a blood-alcohol level above the 0.08 percent limit and driving under the influence of alcohol. He pleaded no contest to the first count and the other count was dismissed, said Frank Mateljan, a spokesman for the city attorney's office. Actress Stockard Channing (search) pleaded no contest to a misdemeanor drunken driving charge stemming from an incident last year on the Hollywood Freeway. Hilton Pleads No Contest in DUI Case

Paris Hilton was placed on 36 months probation and ordered to pay fines after pleading no contest Monday to alcohol-related reckless driving, a reduction of an original charge of driving under the influence. Hilton, 25, did not appear in court. The plea was entered by her attorneys Howard Weitzman and Shawn Chapman Holley, the city attorney's office said. Judge Michael Sauer also ordered her to attend an alcohol education program and imposed other conditions. He gave Hilton the option of reducing her probation to 24 months if she completed 40 hours of community service. No immediate decision was made on that option.

Actor Haley Joel Osment Pleads No Contest to DUI, Pot Charges

Haley Joel Osment pleaded no contest Thursday to misdemeanor drunken driving and drug possession charges resulting from a July accident in which he crashed his car into a mailbox. Superior Court Judge John Doyle sentenced the 18-year-old actor to three years probation and ordered Osment to spend 60 hours in an alcohol rehabilitation and education program, as well as attend at least 26 Alcoholics Anonymous meetings over a six-month period. Kirsten Storms was ordered to attend Alcoholics Anonymous meetings after pleading no contest Wednesday to a misdemeanor charge of drunken driving. Promises is the same place where singer Britney Spears sought treatment after shaving her head. For Lohan, 20, it was a wild holiday weekend even by her own standards. Saturday morning before dawn Lohan crashed her Mercedes on Sunset Boulevard. She fled the scene, but was quickly arrested and charged with driving under the influence. On Monday morning, shocking photos surfaced of the Georgia Rule star passed out in a friend's car. Another photo shows her kneeling on the ground, her back to the camera, apparently before getting into the vehicle. Leslie Sloane Zelnik, Lohan's publicist, didn't return repeated phone calls and e-mail messages from The Associated Press seeking comment. Lohan's estranged father says he wants to talk with his movie star daughter. Ramsey said the public misunderstands the department's criteria for charging people with driving under the influence, or DUI. District law, like laws in Virginia and Maryland, allow for the arrest of any driver a police officer judges to be impaired, regardless of blood alcohol level. Attorney General Robert J. Spagnoletti, who joined Ramsey in testifying before the council's Judiciary Committee, said: There is no evidence to suggest that this is a big problem in the District of Columbia. The system works. The number of deaths declining suggest we're doing it right. Last week the council passed emergency legislation that would bring D.C. law closer to laws in surrounding states. But Spagnoletti said the changes affect only the presumptions that are used in court. They do not change the threshold for arrest: an officer's probable cause to suspect that a driver is impaired by alcohol or drugs. Spagnoletti said many DUI arrests in which drivers have a blood alcohol level below .08, the legal level for intoxication in the District, also involve drug use, which cannot be measured with a breath test. In 2004, D.C. police made 521 arrests for driving while intoxicated, or DWI, and 165 for DUI. Police also arrested 103 people who refused to be tested. Those totals do not include arrests made by the U.S. Capitol Police and others. The Washington Post has published stories about the arrests of drivers with low blood alcohol levels. One report was about the experience of Debra Bolton, a 45-year-old Virginia woman, who said she was arrested for DUI and spent five months fighting the charge after drinking one glass of wine with dinner. Her blood alcohol level was .03, and her case was not prosecuted. Spagnoletti and Ramsey took issue with her story, saying she did not pass any of the four field sobriety tests administered by the arresting officer. In an interview, Bolton said that after the officer told her she was under arrest, she replied: Why? I passed all your little tests.

It was a creative legal argument -- perhaps brilliant, some said -- and after a brief reflection, a Fairfax County judge bought it, declaring that key components of the state's drunken driving laws are unconstitutional.
